UPDATED: Kingman gun rally planned; sheriff takes stance on gun laws

UPDATE:Sheriff Tom Sheahan today clarified his stance on enforcing any new gun laws that might be enacted in the wake of the Dec. 14 Newtown, Conn., mass shooing.

In Wednesday's edition, Mojave County Sheriff's spokeswoman Trish Carter, on behalf of Sheahan, said the sheriff would enforce all laws.

That isn't necessarily the case.

"If I feel a law is unconstitutional, I probably wouldn't enforce it," said Sheahan.

Specifically, the sheriff said he would not enforce any proposed law calling for the confiscation of weapons such as the AR-15 that are already legally owned by Mohave County residents.

"I would never disarm a law-abiding citizen," he said.

To date, the issue of confiscating weapons has not been discussed in Washington, D.C.

Read more on Sheahan's stance in Thursday's edition of the Kingman Daily Miner.

Proponents of gun rights are invited to participate in a "spontaneous peaceful assembly" at noon Friday in front of the Mohave County Sheriff's office.

Local activist Luca Zanna took pains to suggest the event is not sponsored by any group in an interview on Monday.

"This is completely unorganized," he said. "I'm just one voice of many. Me, as an American citizen, I want to stand up for human rights, our inalienable rights and, if you believe in God, our God-given rights not to give up our guns in the face of hysteria in Washington, D.C."

Zanna said his goal for the gathering is two-fold. "Law-abiding citizens want to remind politicians in D.C. and all their bureaucrats we will not comply with unconstitutional laws," he said.

"Number two, we want to let our sheriff know we support him for saying he will not enforce an assault weapons ban in Mohave County. It's my duty to support the sheriff if the sheriff defends our Bill of Rights."

Last week, Mohave County Sheriff Tom Sheahan told the Kingman Daily Miner that he didn't support a ban on assault weapons or restrictions on ammunition.

For Zanna, any restrictions on gun ownership would be wrong, even if the goal were to keep high-powered rifles out of the hands of the mentally ill.

He said he believes requiring Americans to register their guns with law enforcement would be the first step in turning the country into a fascist nation.

"First comes registration and then comes confiscation," he predicted. "This is my line in the sand."

Zanna said he has no idea what kind of turnout he'll have on Friday, but he encourages anyone and everyone who shares his views to join him.

"Everybody is welcome," he said. "I encourage them to open carry to this peaceful assembly."

you can own a hand granade in arizona, each one has to be registered though. nice try. and how are assault rifles weapons of mass destruction, last time i checked they were one of the least use weapons in crimes, but i know you liberals will just dismiss that fact and keep rambling on with your kool aid nonsense.

I use to speak highly of Sheahan and was a supporter of him. Not anymore. I am very disappointed that he felt compelled to politicize his office. He use to quietly do the job we elected him to do. I don't expect my sheriff to stoke the fires of the gun debate. Shame, shame Sheahan.

I hate to burst your in-the-bubble bubble, Freedom Lover but it is. It is a law once signed into law and until the legislature eliminates it.

Thank you to those Sheriffs for standing for the Constitution for the United States of america! In the John Cockrum v. State, the court ruled, “The right of a citizen to bear arms, in lawful defense of himself or the State, is absolute. He does not derive it from the state government, but directly from the sovereign convention of the people that framed the state government. It is one of the “high powers” delegated directly to the citizen, and “is excepted out of the general powers of government.” A law cannot be passed (p.402) to infringe upon or impair it, because it is above the law, and independent of the law-making power.

NO ONE IS COMING TO TAKE YOUR GUNS AWAY!

These people are looking for trouble as no one is coming to take Americans guns away. This is more like a bully in a school yard drawing a line in the sand when there is no threat that exist.

One basic question enters my mind and that is does the sheriff plan on cowing down to a gang of armed thugs?

"The word is mightier the the sword." Ahiqar 500BC "The tongue is mightier then the blade." Euripedes "Indeed, the word of God is living and effective, sharper then any 2 edged sword...." Epistle to Hebrews 4: 12 "Many wearing rapiers are afraid of goosequills." Shakespeare 1600 "The word had a greater tendency to lead the people to that which was just: yea, it had more powerful effect upon the minds of the people then the sword." John Smith Book of Mormons The sheriff is elected to enforce the laws that society pass he does not get to choose which ones he thinks are lawful. At the best this man is pandering to a certain part of our society . At the worst he is advocating a dictatorship if he really believes he does not have to enforce legitimately passed laws. As far as your belief that the Nazi's disarmed the Jews, the Jews did not have guns to take away Propaganda won the day for the Nazi,s not some gun law which they did not pass.

@Anson's Newphew

I agree - if the people of Kingman really wanted to support Sheriff Sheahan they should find a good constitutional lawyer and chip in for a retainer.

@AZ Moderate:

"Indeed. To preserve this fellow's interpretation of the 2nd Amendment, we should allow the mentally ill to be armed. Now that statement's crazy in itself, and deliberately obtuse."

You really know how to 'obfuscate' the issue. Luca was speaking out against proposed laws with the disguised (and dishonest) objective of keeping guns out of the hands of the 'mentally ill'.

Did you know that totalitarian nations have called various groups of people 'mentally ill' PRECISELY for the purpose of taking away all their rights, including possessing firearms? Some groups: homosexuals, Christians, Jews, Indians, gypsies, etc. Get the picture?

The insanity has begun.

There has not been one word spoken to make anyone think the government is going to come to your home and get any guns from you.

The ban that will not pass would only be for new production. Everything between now and then does not apply. Your guns and clips stay YOURS. Nobodies coming for them.

Our Media nationwide has done everything possible to divide the country to its deepest point. Nothing can be trusted as truth.

Now the Sheriff makes a statement that is meaningless due to the fact there wont be guns taken from anyone.

Its perfect time to have a "rally".

"Then Jesus asked them, 'When I sent you out to preach the Good News and you did not have money, a traveler's bag, or extra clothing, did you need anything?'
'No,' they replied.
'But now,' he said, 'take your money and a traveler's bag. And if you don't have a sword, sell your cloak and buy one! For the time has come for this prophecy about me to be fulfilled: "He was counted among the rebels." Yes, everything written about me by the prophets will come true.'
'Look, Lord,' they replied, 'we have two swords among us.'
'That's enough,' he said."
--Luke 22:35-38 [NLT].

I quoted this entire passage to show that I am not lifting anything out of context. The small sword or dagger that Jesus encouraged his disciples to buy was the equivalent of our modern day handgun used for self-defense. He anticipated that they might need it on their journeys when they said they had two, it was deemed sufficient.

The fact that even He would be counted among the rebels [i.e., protesters] of His day, gives me some consolation when some would seek to brand me as "wacky" for insisting upon my Second Amendment rights. I will be there.

Article comment by: Arms of Any Kind

So what is Tom Sheahan's opinion on hand grenades and bombs?

Those ALSO are protected by the 2nd Amendment, so confiscating them would ALSO be illegal -- IF you were going to uphold the US constitution.

NO WHERE in the 2nd Amendment is the word "GUN" used ----- Only the word "ARMED", which allows for bombs and rocket propelled grenades and even tanks.

So if Tom Sheahan will not confiscate guns that can cause mass destruction, then he cannot confiscate other weapons of mass destruction either.

And not being able to regulate these arms will inevitably turn our country into Sudan. And that's not going to be the kind of nation you want to live in. Mark my words.

Thanks, Tom.

Has anyone noticed that the only time we see Sheahan's face or hear his words is when he gets wide media coverage? He doesn't slither out from under his rock if all he has to talk to is locals.
He's an egotistical, self centered good ol' boy who doesn't give a damn about the residents of Mohave County.
He should have been voted out a long time ago and the Sheriff's office cleaned up but he has to have an opponent to run against him before we can replace him... otherwise he keeps his seat no matter how "good ol' boy" connected he is!

Wait a MINUTE. Like him or not Zanna has 1st Amendment Rights like all of you do. And the right to gather etc. Sure makes some of you angry when people get off their butts and do something. Or is this a selective right based on your politics? Besides who died and made you lord executioner and determiner and assigner of selective constitutional rights?

Wait until someone gets hurt at one of these things. Who will be responsible for that, Zanna? He took great pains to claim that no one organized this demonstration when in fact he did. So, he is responsible! They have drawn out every nut job in Mohave County.

I like the part where the sheriff indicates that he will protect law abiding citizens from the removal of their weapons. That cuts out about half of this group. How many have criminal records or are felons?. Doesn't Zanna support criminals and the, mentally ill owning weapons. If he doesn't see the problem with that then he has a problem.

There is a big difference in a law abiding citizen owning a weapon and a criminal owning one.

Anyone that disagrees with these guys gets attacked and called un-American. They are way to out there for most of the law abiding citizens here in Mohave County.

Anyone willing to bet that Mr. Zanna will claim something is unconstitutional at his gun rally and file yet ANOTHER lawsuit! I don't know if he's aware that guns are NOT allowed in a court of law...oh yeah, that's probably unconstitutional also!

@Arizona Moderate

The law suit didn't cost you any money out of pocket, it is covered by the County's liability insurance and the sheriff's liability insurance.

We held a peaceful Oath Keepers rally in what was, at the time, the sheriff's office parking lot in April of 2009 and it didn't require any additional LEO's, why would this be any different. It sounds to me like you are trying to add fuel to the fire. This is not a protest It is to show support for our sheriff to let him know that we will stand behind him. Don't try to twist this into something it is not.

Nice to hear some one in government actually admit to making a mistake. It was also nice of the sheriff and you to let it be known so quick that a mistake was made. This article had turned me against the sheriff and now there is some trust in the office.

Trish Thank you for clarifying that. The Sheriff is the highest law of the land, I would hope he would not go against the Constitution, our president does enough of that.

I fail to see how the sheriff cannot enforce the law. If he wants to change laws, then he should run for a legislative office. The way I see it, he was elected to enforce the law whatever the law is or whether or not he disagrees with it.

No. The sheriff is the chief enforcer of our laws at the County level, even those he disagrees with. The courts are the interpreters of our laws. They get to decide what is and what isn't constitutional.

If the sheriff has an issue with enforcing laws that he doesn't like, then maybe he needs to be in another line of work.

I guess he get's his priorities right once in a while. Now let's see if he can answer the question on new recruits and IQ targets! Reports are coming out that law enforcement departments around the country are targeting candidates that score between 60 and 80. Any higher and the candidate could be looked over. Studies also conclude that these target scores are optimum for "following orders".
