Empie allegedly drove his truck into the side of a recreational vehicle occupied by John Hewett Payne, 66, and Payne's 58-year-old wife at about 5:30 a.m. The impact knocked the RV off its jacks. When Payne opened the front door, Empie was standing in front of him and allegedly shot him in the abdomen.
