Letter: Walleck Ranch and CC&Rs
CC&Rs in a housing complex is a contract signed by all homeowners. It states that you will do as the contract says. It covers all homeowners who own property there. No one is left out. CC&Rs are enforceable by the courts, and any homeowner may and can take you to court for violations of the CC&Rs. It is time for the homeowners here in Walleck Ranch to begin enforcing our CC&Rs, because the violators are lowering our property values.
You must have liked something in the CC&Rs, because you signed the contract. I know a lot of you did not read what you were signing, and a lot of realtors like to skip over the CC&Rs. You need to sit down and read your CC&Rs, not look at them, but read them. If you will not do as the CC&Rs state, you need to sell and buy where there are no CC&Rs. Homeowners who moved here because we liked living in a neighborhood where there are no motor homes, trucks, boats and such other items sitting in our front yards, no children playing basketball in the front yard, trash cans behind the set-backs, no cardboard boxes as signs for garage sales, no cars parked on the rocks. That is why we signed the CC&Rs - to keep our neighborhood clean and nice.
Let's all of us here at Walleck Ranch live by our CC&Rs, and stay out of the courts. I have been there and believe me you will not win. Take your CC&Rs to your attorney and see what he tells you. Mr. Nugent has an airtight contract. Let's live in peace with each other and keep our neighborhood clean and nice.
